Delcath Systems’ board of directors amended the charter: lawsuits against the company must, unless there is a different written agreement, be brought exclusively in the Court of Chancery in Delaware or the U.S. District Court there; Securities Act claims will be litigated in federal district courts in Delaware. In Q2 2026 Delcath reported revenue of USD 29.1m, net income of USD 2.7m and operating cash flow of USD 5.7m, driven by strong sales of the HEPZATO KIT (USD 27.1m; 93.1% of revenue). Delcath treated the first patient at the European Institute of Oncology in Milan in the randomized, controlled phase-2 trial DELUMA, which is evaluating HEPZATO in combination with standard therapies versus standard therapy alone for liver-dominant, HER2-negative metastatic breast cancer. About 90 female patients are to be recruited at more than 20 sites in the US and Europe; the primary endpoint is hepatic progression-free survival, and secondary endpoints include PFS, overall response rate and overall survival.
