NHT Successfully Obtains Contempt of Court Order and Award of Monetary Sanctions against Robert Gutierrez, Owner of Worldwide Heat Treat
HOUSTON--(BUSINESS WIRE)--National Heat Treat (NHT) has achieved another success in its lawsuit against Defendants Robert Gutierrez, Fernando Gutierrez and Worldwide Heat Treat. Defendant Robert Gutierrez has been held in Contempt of Court for violation of the Temporary Restraining Order and the Temporary Injunction previously ordered against Defendants resulting from a hearing in Court on November 16, 2018. Sanctions were also assessed against Defendant Robert Gutierrez in the amount of $35,000, to be paid directly to the Plaintiff, National Heat Treat, by 5:00PM, June 14, 2019. The Court’s Order states if Defendant should further violate such Temporary Injunction, which “remains in full force and effect”, the Defendant Gutierrez may be fined and “confined for up to six months in the Harris County Jail.” NHT initially filed the case on August 31, 2018, when NHT sued Defendants Worldwide Heat Treat, Robert Gutierrez and his brother, Fernando Gutierrez of Worldwide Heat Treat, alleging Robert Gutierrez and his newly formed operation, “Worldwide Heat Treat,” had committed various unlawful actions including Theft, Misappropriation of Trade Secrets and Confidential Information, Tortious Interference with NHT’s Business Relations, Breach of Fiduciary Duty and Constructive Fraud, Unjust Enrichment and Conspiracy (full allegations are publicly filed in: Case No. 2018-59518 in the 11th District Court of Harris County, Texas). Included in such alleged unlawful actions, pursuant to NHT’s allegations, is conversion of NHT’s personal property (i.e., taking NHT’s property) and other alleged dishonest and unlawful conduct, as alleged in NHT’s Petition. NHT has already achieved numerous successes; the Court issued a Temporary Restraining Order against Robert Gutierrez, his brother Fernando and Worldwide Heat Treat signed by the court on August 31, 2018, in the same case. On October 1, 2018, the court again extended the TRO. Further, the Court conducted a temporary injunction hearing and entered an order in favor of NHT granting a temporary injunction against Defendants on November 16, 2018, which is in place until the time of trial (Order file stamped December 5, 2018). Monday’s ruling of Contempt relates to the Court’s finding that Defendants violated the TRO and the Temporary Injunction, specifically noting, “With actual knowledge of the Temporary Restraining Order and the Temporary Injunction, Defendant Gutierrez willingly, knowingly, and intentionally violated the Temporary Restraining Order and Temporary Injunction.” The Contempt Order can be found here and details the sanctions levied by the Court against Defendant Robert Gutierrez.
